Elon Musk has decided that he wants to take Sam Altman and OpenAI to court after all in a brand new lawsuit over whether OpenAI is actually open and non-profit.

The complaint [PDF], filed today in federal court in California, is largely a rehash of his lawsuit from February of this year, which was quietly dropped in June. In fact, the two complaints share much of the same text, although the new complaint is roughly twice as long and accuses Altman and OpenAI of 15 counts of wrongdoing instead of the original five. Musk has also seemingly hired a new legal team.

In short, the Tesla tycoon claims he was fraudulently duped into supporting the launch and growth of the ChatGPT maker, turning it from an open non-profit into a closed for-profit venture, and as such wants back pay for being duped plus. a cut in the money from that support.

In the latest filing, the Musk team added a preamble to the complaint. "Elon Musk's case against Sam Altman and OpenAI is a textbook case of altruism versus greed," the complaint claimed. "Altman, in concert with other defendants, deliberately courted and deceived Musk, violating Musk's humanitarian concerns about the existential dangers posed by artificial intelligence."
