States are required to follow federal minimum wage law. States can pass their own laws to make the wage higher, equal to or lower than the federal law, but they can’t make other changes that overrule the federal law, for instance, who is exempt or how many hours constitutes a work week.

The national living wage (NLW) applies to workers over the age of 25, and on 1st April 2020 is set to increase by 6.2% from £8.21 per hour to £8.72 per hour. This pay rate is legally binding for employers in Scotland and around the UK.

Around 150,000 Scottish workers will receive a pay increase from today, as the National Living Wage and National Minimum Wage uplift comes into effect. The rate rises include a 2.2% increase in the National Living Wage to £8.91, the equivalent of more than £345 extra per year for someone working full-time.

In full, the increases from April 1 2021 are: National Living Wage (23+) has increased 2.2%, from £8.72 to £8.91. National Minimum Wage (21-22) has increased 2%, from £8.20 to £8.36. National Minimum Wage (18-20) has increased 1.7% from £6.45 to £6.56.

Furloughed workers will continue to receive 80 per cent of their income before the rise came into force, and will not see the increase apply to their pay until they return to work.
